Subject aims expressed by acquired skills and competences

Student will be able: - to define three levels of the relations existing within the international trade and their legal regulation: relations among states, relations between entrepreneur and state, relations between entrepreneurs. - to analyse law WTO, - to assess EU regulations regarding individual enterpreneur and analysis of international trade operations, - to formulate simple contracts, - to solve individual cases, - to understand international business.

Summary

The introductory part of the course is devoted to the three levels of the relations existing within the international trade and their legal regulation: relations among states, relations between entreprener and state, relations between entrepreneurs. The core of the course is an analysis of WTO, EU regulations regarding individual enterpreneurs and analysis of international trade operations. Student will be able to formulate simple contracts, solve individual cases, understand international business.

Subject syllabus:

1. Základní roviny úpravy práva mezinárodního obchodu: vztahy mezi státy a mezinárodními organizacemi, vztahy mezi státem a podnikatelem, vztahy mezi obchodníky navzájem. Prameny úpravy - mezinárodní smlouva, zákon. Nestátní prostředky úpravy. Vzájemné vztahy mezi jednotlivými prameny. Výčet pramenů. 2. Mezinárodní ekonomické právo. Státy - státy rozvojové, státy rozvinuté. WTO. Další organizace působící v oblasti mezinárodního obchodu. Mezinárodní smlouvy v oblasti ochrany investic a zamezení dvojího zdanění. 3. Právo zahraničního obchodu ČR. Rozbor některých vybraných norem. Zvláštní problematika vztahů s ES. 4. Externí obchodní vztahy ES - úprava v ČR po vstupu. 5. Vztahy mezi obchodníky - problematika kolizní a přímé úpravy. Nestátní prostředky právní úpravy. 6. Mezinárodní koupě - prodej. Základní charakteristika Úmluvy OSN. Procvičení problematiky její aplikace. 7. Mezinárodní koupě - prodej. Uzavírání smlouvy. Obsah smlouvy. Procvičení problematiky vzniku smlouvy a aplikace úmluvy. 8. Mezinárodní koupě - prodej. Reklamační režim. Sankční systém. Náhrada škody. Penále. Další související otázky. 9. Demonstrace problematiky mezinárodní koupě - prodeje na příkladech. Další související otázky.
