Subject aims expressed by acquired skills and competences

Students will be able to: - describe the legal environment, define the subject of the regulation, characterize the legal regulation and list the basic forms regulation, - understand the principles of public and private law and explain the difference between them - Use acquired knowledge and understanding to clarify and solve model situations - recognize the problem in practice and infer appropriate legal regulation - explain the legal aspect of the problem in practice - explain the legislation and recommend possible solutions to the problem in practice.

Summary

This subject determines the frame of legal regulation of social use and protection of intellectual property. The aim is to acquaint the students with deeper knowledge of legal norms regarding intellectual property and private data protection. It further considers copyright and industrial copyright´s regulation in the Czech Republic and abroad. Also in practical connection legal regulation of advertising as for public and private level is dealt as well as advertising self-regulation.

1. INTELLECTUAL PROPERTY LAW – system, status within Czech law. Infringement of state to intellectual property law. 2. Copyright Law I – term, sorts, copyright establishment. Copyright content. Duration of copyright. 3. Copyright Law II - use of copyright. Free usage. Legal license. Free product. 4. Copyright Law III - license, product with special regime of usage. 5. Copyright Law IV – rights related to copyright. Art performance. Sound and sound-pictured record. Radio and TV broadcasting. Database and its producer. 6. Copyright Law V – collective administration of rights. copyright protection. State control. 7. Trademark I – register, registration, sorts of trademarks, trademark owner. 8. Trademark II – trademark registering process, license and trademark transcription. Duration of validity. Rights termination. Origin and geographical mark. Regime of trademark entitlement. Users of mark. Register, termination. 9. Invention – patent and its owner. Invention protection. License. patenting process. European patent. 10. Other industrial rights – utility design, industrial design, innovation suggestion, topography of semiconductor products, breeding rights, rights execution. 11. Advertising Law I – legal regulation, state control, responsibility for advertisement against the law. 12. Advertising Law II – advertising on TV and Radio, consumer protection and adds, adds within the private data protection. 13.
