Subject aims expressed by acquired skills and competences
The complex orientation in the area of the international trade has been the main objective of this course. The graduates should be able to analyse the basic legal situations such as the formation of the contract, the realisation of the contract and the solving of disputes among international businesmen.The graduates should be able to formulate the simple contract terms, to use INCOTERMS and other non-state rules. They should be able to analyse the legal rules regulating the area of the external trade of the EU. The graduates shall understand the WTO legal regulation. The student should be able to formulate the simple contracts.

Subject syllabus:
The introductory part of the course the students are acquinte with three levels of the relations existing within the international trade and their legal regulation: relations among states, relations between entreprener and state, realtions between entrepreneurs. The core of the course is an analysis of WTO, EU regulations regarding individual enterpreneurs and anaylsis of international trade operations. Student will be able to formulate simple contracts, solve individual cases, understand international business.
International trade law – introduction. Three levels of regulation – international public law, European law, internal law (unified law, international private law, lex mercatoria). International trade law as pedagogical and scientific discipline. Basic terms.
International economical relations and their legal regulation II.
World Trade Organization – analysis. WTO agreements – analysis. interaction of state law and non-state means. Form contracts, trade conditions. Contracts – examples. Wiener agreement – basis.
EU Law – basis, sources of legal regulation.
Legal regulation of ES external trade relations.
International sale and buy.
System CISG. Sale contract creation. Rights and obligations of seller and buyer. Supply conditions. Payment conditions. Claim conditions. Deamnds of both parts when contract is violated. Compensatory damages. Circumstances setting free from responsibility.
UN convention on international goods buy.
Financial aspects of trading transactions. Investments.
International payments and its legal regulation. Documentary and non-documentary payments. Other types of international financial transactions.
Disputes solving between traders. Alternative measures of disputes solving. judicial processing of disputes, solving through arbiters.
