Subject aims expressed by acquired skills and competences

1. differentiate specifics of EC law from other legal systems 2. explain functioning of EU institutions and their importance for legislation 3. identify Treaty provisions applicable to specific situations 4. evaluate the importance of the Court of Justice for the explanation of EC law 5. outline particular sources of EU law

Teaching methods

Summary

The aim of the subject is to equip students with an understanding of EU law, ie. a specific legal order effective in all EU member states. The lectures will focus on EU institutions, principles of functioning of the Communities and sources and character of EU law. Material law from the field of the internal market will be briefly introduced.

Subject syllabus:

1.Evropská integrace - vývoj do současnosti, tři pilíře EU 2.Evropské společenství (ES) - nadstátní charakter, pravomoci ES, subsidiarita, flexibilita 3.Organizační struktura EU (ES)I. Základní orgány 4.Organizační struktura EU (ES) II. 5.Základní právní dokumenty EU a ES (tzv. primární právo) 6.Pojem a charakteristika komunitárního a unijního práva, sekundární právo. Prameny sekundárního práva 7.Přímý účinek a přednost komunitárního práva v členských státech 8.Prosazování práva ES v členských státech - důsledky neprovedení směrnice, kontrolní funkce Komise 9.Jednotlivé žaloby ke komunitárním soudům, tzv. prejudiciální řízení 10.Společný trh, jednotný vnitřní trh, hospodářská a měnová unie 11.Volný pohyb zboží 12.Volný pohyb osob, služeb a kapitálu 13.Schengenský prostor, Spolupráce v oblasti justice a bezpečnosti 14.Aktuální otázky práva EU. Ústavní smlouva
