Subject aims expressed by acquired skills and competences

- to summarize contents and the way of constitutional legal regulations interpretation, - to categorize legal regulations linked to the constitutional order, and the basic rights and freedoms, - to write a constitutional complaint, - to compare legal regulations from the view of compliance with the CR state administration and self-administration.

Summary

Studenti budou seznámeni s ústavním zřízením České republiky. V souvislosti s ústavním zřízením České republiky bude proveden výklad o ústavním právu, a to jednak o hmotném ústavním právu, jakož i o procesním ústavním právu, tedy zejména v souvislosti s řízením u Ústavního soudu ČR. Studenti budou dále seznámeni s veřejnou správou a právními předpisy, které veřejnou správu upravují, a to v členění na státní správu a samosprávu. V souvislosti se státní správou ČR budou studenti seznámeni s kompetenčním zákonem a jeho obsahem, v souvislosti se státní samosprávou budou seznámeni se zákonem o krajích a o obcích. Stručný exkurz bude proveden o tzv. profesní samosprávě. Nedílnou součástí bude výklad o procesních normách, jež se uplatňují ve veřejném sektoru. Zejména jde o správní řád, soudní řád správní a občanský soudní řád, část V. Součástí výuky je též průprava právní dokumentací související s výše uvedeným. Zejména jde tedy o způsob koncepce ústavní stížnosti, správně-právní žaloby, jakož i návrhu na zahájení správního řízení.

Way of continuous check of knowledge in the course of semester

Studenti jsou povinni mimo řádné docházky na přednášky a cvičení rovněž vytvořit v průběhu semestru seminární práci na téma zadané lektorem. Dalším požadavkem na studenta pro získání zápočtu je úspěšné absolvování zápočtového testu, který se bude skládat ze dvou částí: a) praktické (zahrnuje příklady z právní praxe), b) teoretické (formou testu).

Subject syllabus:

1) Introduction to the Constitutional Law 2) Division of powers 3) Legislative process 4) The basic human rights with the accent on the Czech and international law 5) Constitutional court and proceedings before the Constitutional Court 6) Constitutional complaint - formulation, possibilities of using, contents 7) Construction of the public administration in the Czech Republic 8) State administration 9) Self-government 10) Regional government in the Czech Republic 11) Local government in the Czech Republic 12) Administrative procedure - an interpretation according to the administrative procedure 13) Administrative procedure act - an interpretation of administrative justice and proceedings before the Supreme Court 14) Civil procedure and its significance in relation to the administrative law 15) Action and proceeding before the ordinary courts according to the civil proceedings 16) A brief excursion to the legal acts and proceeding before the Constitutional Court of the Czech Republic, the Supreme Administrative Court and before ordinary courts in connection with the action according to part V. of the civil procedure
