Describe the basic types of technical legislation in the Czech republic and the EU. Describe the system technical normalization. Assess the conformity of the products. Define the role of quality management system.

Summary

Importance of technical law regulations for the present society. Historical development of the particular types of technical law regulations. Basic types of technical law regulations in the Czech Republic. Technical law regulations in the EU. Realization of the so-called „Roman agreements“. Systém and organization of the international, EU and Czech technical standardization. Act providing technical requirements on products. Act providing requirements on safety of products. Producer liability act on claims caused by defects of products. Harmonized standards. Product conformity assessment. Quality management system and his role in the product conformity assessment.

Subject syllabus:

Lectures: - Introduction to technical and legal regulations, the importance of techno- law for contemporary society, the historical development of types of technical legislation, the basic types of technical and legal regulations in the Czech Republic. - The generally binding legal regulations of a technical nature in the CR; concept and form of laws - laws, government orders, decrees, their importance for the protection of public interest, the relationship between the generally binding legal technical regulations and technical standards. - Legislation of a technical nature as a tool to support and not barrier to international trade and research and development of new products; harmonization of Czech legislation with EU legislation, ie an application Community law into the Czech legal order in terms of legislation technical nature. - Legislation of a technical nature in the EU and EU primary law, EU secondary legislation - regulations, directives, decisions, recommendations and opinion. - The EU as an instrument for regulating the technical requirements. Legally binding for EU Member States, by way of application of legislation these states, the relationship of technical guidelines and European standards EN harmonized EN. - System and technical standardization organization in the country. Czech technical standards BS, legal non-binding, the role of the Czech Standards Institute CSNI, the importance of technical standards and their application in business. The options for the use of industry standards canceled. Corporate standards and the possibility of their use in commerce. - The organization and standardization in the EU, a European technical standards EN, and their application to the system of technical standards of each member EU countries, the role of the CEN and CENELEC. - The organization and standardization on an international scale, Role of ISO and IEC technical committees, creation and approval of new standards. Specifics of technical standardization in the U.S. (ASI standards, ASME, API, etc.). - Conformity assessment of products in the EU, the application of so-called "Rome agreements, distribution products into two groups according to residual operational risk role of the EU directives on the protection of public interest, showing a modular system agreement, concerted practice in the EU - 8 modules, compliance, Product Certification - Certificate product type, activity authorized person sign Conformity CE Declaration of Conformity. - Act No. 22/1997 Coll. on technical requirements for products as text, purpose and structure of the Act, the implementation for public interest by the Government NV, established products, compliance, the role of authorized persons, notification of authorized persons. - Quality Management System and its role in demonstrating conformity requirements standards of ISO 9000:2000 quality management system certification, good function of the quality management system as a prerequisite for stable product quality, EFQM excellence model. - Act No. 59/1998 Coll. the responsibility for damage caused by a defect product as amended, Act No. 102/2001 Coll. the general safety products, as amended. Exercise: - Introduction to the concept of public interest, practical examples. - Generally binding legal regulations of a technical nature in the CR - Basic types, their meaning and differences between them. - Technical standards as regulations that have general applicability, types of technical standards used in the CR, examples of their use in commercial contact - Importance of EU directives as a tool for regulating the technical requirements. Protection of public interest without creating barriers to international trade and Research and development of new produktů.Způsob adoption of EU directives into Czech legislation. - Management of technical standardization in the Republic, functions and powers of CSNI, creation of the CSN, rules for the application of EU norms and standards in the ISO system of technical standards in the country. - Technical standards in the EU, the activity of the CEN and CENELEC, the creation and announcing the harmonized standards. - ISO and IEC, membership in these organizations, creation of international standards, approval process, the application of international standards of ISO and IEC in the country. - The Treaty of Rome, the EU's approach to the explanation of products, divided into two groups operating under the residual risk. The role of EU directives and consistent requirements to demonstrate compliance with these guidelines - 8 modules. - Practical examples of procedures (modules) of attestation of conformity of products Government Regulation No. 24/2003 Coll. (Directive 98/37/EC) for machinery and No. 26/2003 Coll. (Directive 97/23/EC) for pressure equipment. - Act No. 22/1997 Coll. on technical requirements for products (as text); analysis requirements of the Act and its amendments in connection with the CR to EU (např.paragraf 13b), examples of the application requirements of the Act. - Explanation of the role of quality management system according to EN ISO 9001:2000 for demonstrating product compliance with EU directives, particularly in Product certification - type certificate was issued by an authorized person
